HERE’S WHAT YOU NEED TO KNOWN ABOUT THE LAWS AND WHAT HAS CHANGED

When physicians lease medical office space from hospitals, perhaps the only surefire way to eliminate the possibility of violating the Anti-Kickback Statute (AKS) or the Stark Law is for the hospitals to directly employ those physicians.

If the hospitals are the employers, legal experts reason, how they structure the medical office leases or overhead allocations of their physician-employees becomes irrelevant with respect to the federal laws regarding physician self-referrals.
